Which data is processed?


Usage Data in regard to your visit of our website

When you visit our Internet pages, personal data is also processed; in order for the pages to be displayed in your browser, the IP address and other information about the browser of the end device used must be processed.

The following data is logged:

  • IP address of the accessing device (for a maximum of 7 days)
  • Operating system of the accessing device
  • Browser version of the accessing device
  • Name of the retrieved file
  • Date and time of the retrieval
  • Amount of data transferred
  • Referring URL

The IP address is deleted after 7 days at the latest from all systems used in connection with the operation of these Internet pages. We can then no longer establish a personal reference from the remaining data.

The above-mentioned personal data are processed for the purpose of ensuring the confidentiality and integrity of the personal data processed with our IT systems. A further purpose is the correction of errors on our website.

The legal basis for this data processing described above is Art. 6 para. 1 lit. f) GDPR. Our legitimate interest within the meaning of Art. 6 (1) (f) GDPR is the operation of this website as well as the confidentiality, integrity and availability of data processed in connection with the usage of this website.

Contact form


We offer a contact form on our website, which you can use to request information about our services, to request or schedule a meeting or demo, or to contact us in general. In addition to the voluntary information and your message content, we might require you to provide the following information, depending on the specific purpose of the given contact form.:

  • Company
  • Last name
  • Name
  • Email address

We need this information to process your request, to address you correctly and to send you a reply. Inquiries received via the contact form on our website are usually stored in our CRM system.

The CRM system is regularly checked to see whether data can be deleted. If data is no longer required in the context of a customer or interested party relationship or if a conflicting interest of the customer prevails, we will delete the relevant data, provided that there are no legal retention obligations to the contrary.

The legal basis for this data processing is Art. 6 para. 1 lit. f) GDPR. Our legitimate interest within the meaning of Art. 6 para. 1 lit. f) is in the communication with customers and interested parties.

User account


No registration is necessary to visit the Marketplace. For further functions, such as ordering or offering services on the Marketplace, a user account is required. Such user account can be created at any time; only the necessary personal data must be provided for this purpose:

  • Full name
  • Email address
  • Password

As far as necessary for the processing of contracts for ordered/offered services, apinity will collect further personal data, e.g. payment data, company, position.

The purpose of the processing is to set up the user account with the extended functions for commissioning/offering services on the Marketplace.

The legal basis for the processing is Art. 6 para. 1 lit. b) DSGVO (processing for contract fulfilment) with regard to the fulfilment of apinity’s obligations from the user contract on the use of the Marketplace.

Existing user accounts deleted upon request or if a user has not used the service for 3 years. If a user account cannot be deleted due to dependencies in the system, it will be anonymized.

Cookies

Cookies are used on our website. Cookies are small text files that are stored in your terminal device via your browser. The cookies are necessary to enable certain functions of our Internet pages and to increase user-friendliness. On the one hand, we use session cookies, which are automatically deleted by your browser immediately after you have finished visiting the Internet pages.

In the area of web analysis, we also use persistent cookies. You have the option of preventing the setting of cookies by making the appropriate settings in your browser. However, we would like to point out that the use of our Internet pages may then only be possible to a limited extent. Cookies do not install or start any programs or other applications on your computer.

The legal basis for this data processing is Art. 6 para. 1 lit. a) GDPR (consent).

Hubspot

We use HubSpot products on our website for the purposes of customer relationship management and to carry out marketing activities. HubSpot is a software company from the USA with a branch office HubSpot Ireland Limited in 2nd Floor 30 North Wall Quay, Dublin 1, Ireland.

This software is used on the website primarily to provide forms, newsletter registrations and email marketing in general. Other Hubspot functions we use include automated mailings, social media publishing (especially in the context of LinkedIn), contact management and landing pages.

HubSpot uses cookies (see also section -> Cookies). HubSpot analyses the information collected (e.g. IP address, geographical location, type of browser, duration of the visit and pages accessed) on our behalf so that we can generate reports on the visit and the pages visited.

Information collected by HubSpot (e.g. via the contact form or landing pages) is stored on the servers of HubSpot’s service providers. If this information is in the context of website analyses, it will only be processed if you have given us your consent to do so and thus on the basis of Art. 6 para. 1 lit. a) GDPR. We process information that you provide yourself in the context of contacting us on the basis of Art. 6 para. 1 lit. b) GDPR, insofar as you provide the information in preparation for the establishment or execution of a contractual relationship with us; otherwise, the processing is based on Art. 6 para. 1 lit. f) GDPR, our legitimate interest lies in communicating with our customers and website users.

Since personal data may be transferred by HubSpot to Hubspot group companies or subcontractors of Hubspot in countries outside the EU and the EEA, an adequate level of data protection must be ensured by special protection mechanisms and guarantees. For the USA, there is an adequacy decision of the EU Commission pursuant to Art. 45 para. 1 GDPR with regard to companies with certification under the EU-U.S. Data Privacy Framework. HubSpot, Inc. is certified in accordance with the EU-U.S. Data Privacy Framework and is therefore committed to complying with appropriate data protection standards, which can be viewed at the following link: https://www.dataprivacyframework.gov/s/participant-search/participant-detail?id=a2zt0000000TN8pAAG&status=Active. For potential transfers to other third countries outside the EU and the EEA for which there is no adequacy decision by the EU Commission, standard data protection clauses pursuant to Art. 46 para. 2 lit. c GDPR are also agreed.

The data processed in Hubspot will be deleted by us as soon as it is no longer required to fulfil the purpose for which it was collected.

You can permanently object to the collection of data by HubSpot and the setting of cookies by preventing the storage of cookies through your browser settings. You can also object to the processing of your personal data at any time with effect for the future by sending an informal email to info@apinity.io.

Google Analytics

We use Google Analytics 4 to analyse the use of our website. The data obtained from this is used to optimise our website and our marketing-measures.

Google Analytics is a service provided by Google Ireland Limited (Gordon House, Barrow Street, Dublin 4, Ireland) (hereinafter “Google”). Google processes the website-usage data on our behalf as a data processor and is contractually obliged to take measures to ensure the security and confidentiality of the processed data.

Google Analytics uses cookies that enable us to analyse your use of our website. The information collected by the cookies about your use of this website is generally transmitted to a Google server in the USA and stored there (see below for more details for data-transfers to the USA).

We use the “User ID“ function. With the help of the user ID, we can assign a unique, permanent ID to one or more sessions (and the activities within these sessions) and analyse user behaviour across devices.

We use „Google Signals“. This allows Google Analytics to collect additional information about users who have activated personalised ads (interests and demographic data) and ads can be delivered to these users in cross-device remarketing campaigns

In Google Analytics 4, the anonymisation of IP addresses is activated by default; therefore, your IP address will always be shortened by Google within member states of the European Union or in other contracting states of the Agreement on the European Economic Area and only in exceptional cases transmitted as a full IP address to a Google server in the USA and only shortened there. According to Google, the IP address transmitted by your browser as part of Google Analytics will never be merged with other Google data.

During your visit to the website, your user behaviour is recorded in the form of “events”. Events can be

  • Page views
  • First visit to the website
  • Start of the session
  • Visited web pages
  • Your “click path”, interaction with the website
  • Scrolls (whenever a user scrolls to the bottom of the page (90%))
  • Clicks on external links
  • Internal search queries
  • Interaction with videos
  • file downloads
  • Ads viewed / clicked on
  • language setting

Also recorded:

  • Your approximate location (region)
  • Date and time of your visit
  • Your IP address (in truncated form)
  • Technical information about your browser and the end devices you use (e.g. language setting, screen resolution)
  • Your internet provider
  • the referrer URL (via which website/advertising medium you came to this website)

Google will use this information on our behalf to analyse your use of the website and to compile reports on website activity. The reports provided by Google Analytics are used to analyse the performance of our website and the success of our marketing campaigns.

In addition to Google as our processor, recipients of the data may also be Google group companies, specifically

Since personal data may be transferred by Google to Google group companies or Google subcontractors in countries outside the EU and the EEA, an adequate level of data protection must be ensured by means of special protection mechanisms and guarantees. For the USA, there is an adequacy decision by the EU Commission pursuant to Art. 45 (1) GDPR with regard to companies with certification under the EU-U.S. Data Privacy Framework. Google is certified in accordance with the EU-U.S. Data Privacy Framework and is therefore committed to complying with appropriate data protection standards. As Google servers are distributed worldwide and a transfer to third countries (for example to Singapore) cannot be completely ruled out, we have also concluded the EU standard contractual clauses with the provider.

The data sent by us and linked to cookies is automatically deleted after 2 months. The maximum lifespan of Google Analytics cookies is 2 years. Data whose retention period has been reached is automatically deleted once a month.

The legal basis for this data processing is your consent in accordance with Art. 6 para. 1 sentence 1 lit. a GDPR and § 25 para. 1 sentence 1 TTDSG. You can revoke your consent at any time with effect for the future by accessing the cookie settings A link to consent management is required here and changing your selection there. This does not affect the lawfulness of the processing carried out on the basis of the consent until revocation.

You can also prevent the storage of cookies from the outset by configuring your browser software accordingly. However, if you configure your browser to reject all cookies, this may restrict the functionality of this and other websites. You can also prevent Google from collecting the data generated by the cookie and relating to your use of the website (including your IP address) and from processing this data by Google by not giving your consent to the setting of the cookie or by downloading and installing a browser add-on offered for your browser to deactivate Google Analytics.

LinkedIn Insights Tag

We use the so-called conversion tracking with LinkedIn Insights Tag on our website, a tool of LinkedIn Ireland, Wilton Plaza, Wilton Place, Dublin 2, Ireland, by integrating the “Insight Tag” of LinkedIn on our website. A cookie is set on your end device by LinkedIn when the page is called up.

This informs LinkedIn that you have visited our website. In this course, your IP address, the times of the visit, page views and events such as the playing of videos are collected. This serves the purpose of constantly optimizing our website through a statistical evalua-tion of its use. In this way, we learn about which LinkedIn ad or interaction on LinkedIn you came to our website and are thus able to better control the playout of our advertising.

Please note that the data may be stored and processed by LinkedIn, so that a connection to the respective user profile is possible and LinkedIn can use the data for its own advertising purposes. Purposes of the processing of personal data

We process the aforementioned data for the operation of our website and to fulfill contractual obligations to our customers. In the case of inquiries from you outside of an active customer relationship, we process the data for the purposes of sales and advertising.
